Welcome to Saree.com, operated by APSC Emart LLP ("Saree.com", "Company", "we", "us" or "our"). By accessing, browsing or purchasing from our website, you ("Customer", "User" or "you") agree to these Terms & Conditions ("Terms"), our Privacy Policy and Refund & Return Policy.

If you do not agree with these Terms, please do not use our Website or Services.

1. ELIGIBILITY & ACCOUNT

You must be at least 18 years old, or use the Website with the consent and supervision of a parent or legal guardian.

Where an account is required, you agree to provide accurate, complete and current information and to keep your login credentials confidential. You are responsible for all activity under your account and must immediately notify us of any unauthorized use.

You may not create accounts using false information, impersonate another person, or use an account for unlawful purposes.

2. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and prices are accurate. However, actual colours may vary depending on your device or screen settings.

Minor variations in colour, texture, embroidery, print, weave or finish may occur due to the nature of fabrics and handcrafted products and shall not necessarily be considered defects.

Product information, availability and pricing may be changed or discontinued at our discretion without prior notice.

All products are subject to availability.

3. ORDERS & ACCEPTANCE

Placing an order constitutes an offer by you to purchase the selected products.

An order is considered accepted only when Saree.com confirms acceptance and/or dispatches the order. We reserve the right to refuse, modify or cancel any order where permitted by law, including in cases of pricing errors, stock unavailability, suspected fraud or incorrect information.

Once an order has been accepted or processing has commenced, cancellation may not be possible.

You are responsible for reviewing your order, measurements, delivery address, contact details and selected products before placing the order.

4. CUSTOMISED & VIDEO-CALL PURCHASES

Products purchased through video calls, assisted shopping, personalised selection, customisation or customer-provided measurements are considered specially selected/customised orders.

Such orders are non-returnable and non-refundable, except where required under applicable law or where Saree.com determines that the product is defective or incorrectly supplied.

Where measurements are provided by the customer, Saree.com shall not be responsible for fitting issues arising from incorrect, incomplete or subsequently changed measurements.

Any alteration or correction offered by Saree.com shall be considered the appropriate remedy where reasonably possible.

5. PRICES & PAYMENT

All prices are displayed in INR, unless otherwise stated, and applicable taxes will be charged as displayed at checkout.

Prices, discounts and promotional offers may change without prior notice. Promotional offers may be subject to additional terms.

You authorise us and our payment service providers to process payment for your order. You represent that you are authorised to use the payment method provided.

In case of a pricing, payment or system error, we reserve the right to correct the error and, where applicable, cancel or modify the affected order and issue a refund.

6. SHIPPING & DELIVERY

We provide estimated delivery timelines at checkout. Delivery dates are estimates only and are not guaranteed, unless expressly confirmed otherwise.

We are not responsible for delays caused by courier companies, customs, weather, strikes, natural disasters, government restrictions or other events beyond our reasonable control.

You are responsible for providing a complete and accurate delivery address, phone number and other required information.

For international orders, the customer is responsible for applicable customs duties, import taxes, local taxes, clearance charges and other destination-country charges, unless expressly stated otherwise.

Any loss, delay or damage claim must be reported to Saree.com within the period specified in our Shipping Policy.

7. RETURNS, EXCHANGES & REFUNDS

Returns and exchanges are governed exclusively by our Refund & Return Policy.

Unless otherwise stated on the product page, eligible products must be returned within 48 hours of delivery and must be:

  • Unused and unworn;
  • Unwashed and unaltered;
  • In original condition;
  • With original tags, packaging and accessories intact.

The following are generally non-returnable/non-refundable:

  • Final-sale products;
  • Customised or personalised products;
  • Products purchased through Video Call/assisted shopping;
  • Products altered at the customer's request; and
  • Any product specifically identified as non-returnable on the Website.

Returns are subject to inspection and approval by Saree.com.

Refunds, where approved, will normally be processed to the original payment method within 15 business days after receipt and inspection of the returned product.

Original shipping charges and return shipping charges are non-refundable unless the return is due to an error or defect attributable to Saree.com.

For damaged, defective or incorrect products, the customer must notify us promptly and provide clear photographs/videos and other information reasonably requested by us.

8. INTELLECTUAL PROPERTY

All content on Saree.com, including trademarks, logos, photographs, product images, videos, text, graphics, designs, layouts, product descriptions and other materials, is owned by or licensed to APSC Emart LLP and is protected by applicable intellectual-property laws.

You may use the Website solely for personal and lawful purposes.

You may not copy, reproduce, modify, distribute, publish, sell, transmit, scrape, create derivative works from, or commercially exploit any Website content without our prior written permission.

All rights not expressly granted to you are reserved by Saree.com.

9. CUSTOMER REVIEWS & FEEDBACK

By submitting reviews, photographs, comments, suggestions or other content to Saree.com ("Feedback"), you grant us a worldwide, royalty-free, perpetual and transferable licence to use, reproduce, modify, publish, display and distribute such content for business, promotional and marketing purposes.

You represent that you own or have the necessary rights to the content submitted and that it does not infringe any third-party rights.

We reserve the right to remove content that is unlawful, defamatory, abusive, obscene, misleading, infringing or otherwise inappropriate.

10. PROHIBITED USE

You agree not to:

  • Use the Website for unlawful or fraudulent purposes;
  • Misrepresent your identity or provide false information;

We are not responsible for the availability, accuracy, security, policies or practices of third-party websites or services.

Your use of third-party services is subject to their respective terms and policies.

12. SHOPIFY

Saree.com is hosted and powered by Shopify. However, purchases made through Saree.com are transactions between you and APSC Emart LLP.

To the extent permitted by applicable law, Shopify and its affiliates shall not be responsible for products purchased from Saree.com or disputes arising directly between you and Saree.com.

13. PRIVACY

Your personal information is handled in accordance with our Privacy Policy.

We may share necessary information with payment processors, logistics partners, technology providers, Shopify and other service providers to process orders, payments, delivery and customer support, subject to applicable law.

14. ERRORS & OMISSIONS

Despite our efforts, the Website may occasionally contain typographical errors, inaccurate information or omissions relating to products, prices, availability, promotions, shipping charges or delivery timelines.

We reserve the right to correct such errors, update information and, where permitted by law, cancel or modify affected orders.

15. DISCLAIMER

To the maximum extent permitted by applicable law, the Website and its content are provided on an "as is" and "as available" basis.

We do not guarantee that the Website will always be uninterrupted, secure, error-free or available at all times.

Nothing in these Terms excludes or limits any consumer rights, warranties or remedies that cannot legally be excluded or limited under applicable law.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Saree.com, APSC Emart LLP, its partners, directors, employees, affiliates, agents, contractors and service providers shall not be liable for any indirect, incidental, special, consequential or punitive loss, including loss of profits, revenue, data or business arising from your use of the Website or purchase of products.

Our liability, where legally permitted to be limited, shall be limited to the amount paid by you for the specific product or order giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be excluded or limited under applicable law.

17. INDEMNIFICATION

You agree to indemnify and hold harmless APSC Emart LLP, Saree.com, its partners, directors, employees, affiliates, agents and service providers against claims, losses, liabilities, damages and reasonable legal expenses arising from:

  1. Your breach of these Terms;
  2. Your violation of applicable law;
  3. Your misuse of the Website; or
  4. Your infringement of any third-party rights.

This obligation shall apply to the extent permitted by applicable law.

18. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, fire, flood, war, strikes, government restrictions, epidemics, transportation disruptions, internet or technology failures, customs delays or other force majeure events.

19. TERMINATION

We may suspend or terminate your access to the Website or Services if you violate these Terms, engage in fraudulent or abusive activity, or where otherwise permitted by law.

Termination will not affect any rights or obligations that accrued before termination or provisions which, by their nature, are intended to survive termination.

20. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy and other policies expressly incorporated into these Terms, constitute the entire agreement between you and Saree.com regarding your use of the Website and Services.

Failure by us to enforce any provision shall not constitute a waiver of that provision.

22. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations where permitted by law.

23. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer protection laws and statutory remedies, disputes shall be subject to the jurisdiction of the competent courts at Ahmedabad, Gujarat, India.

Nothing in this clause shall restrict any mandatory rights or remedies available to consumers under applicable law.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time by publishing the revised version on the Website.

The updated Terms will become effective from the date stated on the Website. Your continued use of the Website after such changes constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
